Defendant William J. West was indicted for the crime of abortion. After pleading not guilty and waiving a jury, he was found guilty of that charge in a bench trial. Thereupon defendant moved for an acquittal or for a new trial charging that he had been convicted on an indictment which was unintelligible and void.
