Defendant, Neal Percy Brotherton, was convicted in a jury trial of transporting in interstate commerce a motor vehicle, knowing the same to have been stolen, in violation of 18 U.S.C. § 2312. The indictment charged in a second count a violation of § 2313 for allegedly receiving and concealing the motor vehicle, which was moving in interstate commerce, knowing the same to have been stolen.
