The defendant is charged with violation of 22 D.C.Code § 2001(a) (1) (A); § 2001(a) (1) (E) which make it a crime to knowingly sell or possess with intent to sell obscene material.

The defendant made a pretrial motion to dismiss on the grounds that: (1) He was denied a prior adversary hearing to determine whether the materials which are the subject of the charge were obscene; (2) The practices of the Morals...
