MASTERSON, District Judge.

The defendant in this criminal prosecution has been indicted for failure to perform a duty imposed by the Selective Service Act, to wit, failure to report for and submit to induction into the Armed Forces in violation of 50 U.S.C. App. §§ 454, 462. Defendant waived a jury trial and moved for a judgment of acquittal at the close of all the evidence pursuant to Rule 29(b) of the Federal Rules of Criminal Procedure...
