LATCHUM, District Judge.

The defendant moves to dismiss the information filed against him on the ground that it fails to state facts sufficient to constitute an offense against the United States.1 The information charges:

"On or about May 19, 1970, at Wilmington, Delaware, in the Judicial District of Delaware, Thomas L. Little, being over eighteen years of age, in response to a request of an authorized employee...
