On May 24, 1966, plaintiff George Gazdecki was injured when the car he was operating was struck in the rear by a 1965 Buick automobile, being operated by defendant Willie James Cargill. One week before the accident Cargill had paid $200 as a deposit on the automobile to P.L. Grissom & Son, a Michigan corporation, licensed automobile dealer.
