The defendant, Eugene Hamilton, was indicted for failure to comply with an order of his Local Board to report for and to submit to civilian employment in lieu of induction to the Armed Forces of the United States under 50 U.S.C. App. Section 462. After the defendant waived trial by jury, he and the Government submitted this matter on stipulated facts along with evidence previously adduced at the hearing of motions.
