MANSFIELD, District Judge.

In this action against the Clerk of New York County attacking New York's jury selection system and, more specifically, a statutory provision (N.Y. Judiciary Law, McKinney's Consol.Laws, c. 30, § 599(7)) authorizing exemption of women from jury service as violative of plaintiff's constitutional rights, defendant moves to dismiss pursuant to Rule 12(b) (1) and (6).
