FREDERICK van PELT BRYAN, District Judge:

This is an action pursuant to Sections 4 and 16 of the Clayton Act, 15 U.S.C. §§ 15 and 26, for violation of Section 1 of the Sherman Act, 15 U.S.C. § 1, seeking damages and a permanent injunction.

The complaint alleges that plaintiff, Friends of Animals, Inc., is a non-profit corporation whose principal objective is the reduction of the number of homeless and unwanted cats and dogs...
