Defendant was convicted of burglary not in a dwelling and was sentenced to four years' imprisonment.

The Pendleton Body Shop in Pendleton, where defendant was a former employe, was in the same building as Ron Baldwin's automotive dealership. The two businesses were separated by a wall containing a number of windows.
