It is the order of the court that for failure to prosecute the appeal in the above case with due diligence, Jeffrey M. Levy, counsel for the appellant, is assessed a penalty of $300 to be paid to the clerk of this court on or before 5:00 p. m. on June 18, 1970. Said sum is to be placed in the clerk's deposit fund to be transferred to the clerk of the United States District Court for the Southern District of California for further transfer...
