The appellant, Juan Jose Betancourt, a Costa Rican, was indicted in the United States District Court for the Northern District of Florida:

"That on or about May 7, 1969, in the Northern District of Florida, JUAN JOSE BETANCOURT, also known as Jose Juan Betancourt, knowingly, and with intent to defraud the United States, did import and bring into the United States approximately ninety (90) marihuana...
