Plaintiff in error, Dan T. Jones, hereinafter referred to as the defendant, was convicted in the District Court of Oklahoma County with the crime of Burglary Second Degree, After Former Conviction of a Felony and sentenced to twenty years in the penitentiary. From this judgment and sentence he has appealed to this Court.
