BOYLE, District Judge:

This is an action brought under the Jones Act to recover damages for injuries sustained by the plaintiff in an automobile accident.

This cause came on for hearing January 21, 1970, on the defendant's motion for a summary judgment dismissing the complaint on the ground that the plaintiff, at the time of the injury, was not within the course of his employment, and hence has no cause of action under the Jones Act.
