WRIGHT, Chief Judge.

The appellant was charged with a felony for delivery of a controlled substance, heroin, in violation of Ark.Stat.Ann. § 82-2617. At the end of trial before the court, without a jury, he was found guilty as charged and punishment fixed at 10 years imprisonment with 7 years suspended and 5 of those years on probation.
