Bobby McCurdy and Albert McElroy were jointly indicted, tried and convicted by a jury and sentenced for having, on October 26, 1968, assaulted Martin Scott, a policeman, by means or force likely to produce great bodily harm, contrary to Section 2901.241, Revised Code.

They assign five errors:

1. That the trial court erred in overruling the motion for new trial on behalf of the defendants...
