MEMORANDUM OPINION

HARPER, Chief Judge.

This matter is before the court on petitioner's motion to vacate judgment and sentence imposed by this court on June 3, 1966. Petitioner was convicted of illegal purchase and sale of narcotics in violation of 26 U.S.C.A. §§ 4704(a) and 4705(a). The conviction was affirmed, Kibby, Stewart and McFadden v. United States, 372 F.2d 598
