OPINION

DYER, Chief Justice.

The respondent here, Claude Lee Logan, has been convicted of murder in the second degree for the slaying of one Robert Bowerman. The case was tried upon a plea of not guilty by reason of necessary self-defense. In the motion for a new trial respondent assigned only one error; that is, the evidence preponderates against the verdict of the jury and in favor of his innocence. The trial judge overruled the motion for a new trial...
