This is a civil action which was commenced March 31, 1964, by the issuance of a writ of summons in an action of trespass on the case for negligence. It was tried to a Superior Court justice and a jury which returned a verdict for the defendant, and, within the time provided by law, the plaintiff filed a motion for a new trial.
