Eisenbeck alleging that on February 28, 1966 he went to work for Eisenbeck under an oral employment contract for an indefinite period of time at a stipulated salary and, in addition, "a guarantee of one-third (1/3rd) to one-half (½) of five per cent (5%) of the gross receipts of defendant's business."
