The defendant, Nicholas Gasparino, was indicted on December 16, 1969, for the crime of murder. He moves to dismiss the indictment on the ground that he had obtained immunity from a different Grand Jury than the one that indicted him, which Grand Jury previously had found Indictment No. 1126/68, based, in part, on Gasparino's testimony, charging John De Tore and Kenneth Wedra with the crime of murder.
