Each of the defendants has moved to dismiss the complaint on the grounds that it fails to state a claim upon which relief can be granted. The defendants Mortgage Associates, Inc. and Henry Butler and Jessie Butler, have moved, in addition, for dismissal on the grounds that there is an absence of diversity and that the amount in controversy is less than $10,000.
