SMITH, Justice.

This is an automobile negligence case. Trial in the Caledonia Court resulted in a verdict for the defendant. The only question presented on this appeal by the plaintiff is that the trial court was in error in denying the motion of the plaintiff that the issue of contributory negligence be taken from the jury, and that the jury be instructed that contributory negligence was not an issue.
