Samuel Grass and Stephen Roberts were convicted of the crimes commonly known as assault with a deadly weapon (C.R.S. 1963, 40-2-34) and conspiracy to commit an assault with a deadly weapon (C.R.S. 1963, 40-7-35). Grass was thereafter sentenced to a term of from one to five years in the state penitentiary on the assault charge, and to a term of from four to ten years on the conspiracy charge, the terms to be served concurrently.
