This is an appeal upon questions of law from an order of the Court of Common Pleas of Hamilton County granting plaintiff-appellee summary judgment.
In his petition plaintiff alleges that on March 18, 1967, a corporation contracted with appellant to purchase her real estate; plaintiff is the assignee of such contract; the contract provides "any assessment on the * * * property is to be paid by the seller"; an assessment in the sum of $8,930.95...
