The plaintiff was injured while riding as a passenger in a motor vehicle operated by the defendant Rollins in Derby, Vermont, early on the morning of September 3, 1965. There is little or no dispute about the facts of the accident. The Rollins vehicle was traveling south on U. S. Route 5.
