This case originated when Ralph Conley, an employee of Bertram & Thacker, sued Ashland Oil & Refining Company for damages. Conley was burned in a fire which occurred while a well was being drilled for Ashland. A third-party complaint was filed by Ashland against Bertram & Thacker seeking indemnity for any judgment that Conley might secure against it.
