WEST, District Judge:

During the summer of 1969 one James Oliney, a Negro youth, was shot and killed by a white policeman in Baton Rouge, Louisiana. According to the policeman, Oliney was suspected of burglary and an attempt was made to arrest him. Before the arrest could be completed, according to the policeman, Oliney attempted to attack the officer with a knife in his hand and the shooting which proved fatal to Oliney...
