This matter is before this court on writs seeking the annulment of an order by a lower court judge which granted plaintiff, Leon Levy, a new trial.

The factual posture of the case is that plaintiff originally filed suit on September 27, 1967, in Jefferson Parish, for damages resulting from injuries he sustained in an intersectional collision with a truck owned by defendant Southern Pacific Railroad Company, which its employee Stelly was driving...
