The defendant was indicted and subsequently convicted by a jury of committing an indecent assault and battery on a child under the age of 13 in violation of G.L. 1956, § 11-37-6, as amended.1 The trial justice denied his motion for a new trial and sentenced him to serve a term of 40 months in the adult correctional institutions.
