The jury returned a verdict finding defendant guilty of manslaughter in the second degree and from the judgment thereon he has appealed.

Defendant was arrested on October 16, 1967. He had a preliminary hearing on November 6 and 7, 1967, at which defendant was represented by court appointed counsel who continued to represent him at the trial and on appeal.
