GALBREATH, Judge.

This is an appeal in the nature of a writ of error from the action of the Criminal Court of Shelby County in overruling the plaintiff in error's motion for a new trial following a conviction of second degree murder, for which the jury imposed a sentence of not more than seventeen (17) years in the State Penitentiary. The indictment charged murder in the first degree.
