TACKETT, Justice.

Otto Thompson, appellant, was tried before a jury on March 20, 1952, along with Terrell David Watson, and found guilty of first degree murder. They were sentenced to life imprisonment in the New Mexico State Penitentiary. On January 8, 1968, Thompson filed a petition for a writ of habeas corpus in the District Court of Eddy County, alleging that his constitutional rights had been violated.
