HUMPHREYS, Justice.

Long was convicted of murder in the second degree and sentenced to serve not more than twenty years in the State Penitentiary. He appealed his conviction to the Court of Criminal Appeals, where it was reversed by that Court, particularly on authority of Poteete v. State, 68 Tenn. 261.
