Plaintiff, Clinton Dees, filed an action for damages in the Circuit Court of Jackson County, Mississippi, against American Cyanimid Company and the Mississippi Export Railroad Company. Both defendants joined in a petition for removal of the action to this Court and subsequently each moved to dismiss Mississippi Export Railroad as a party.
