The plaintiff in error was indicted for violating the liquor laws on September 7, 1967, and was tried for this offense on September 22, 1967, the jury returning a guilty verdict and fixing the defendant's punishment at ninety (90) days in jail and assessing a fine of two hundred and fifty ($250.00) dollars.
