HUMPHREYS, Justice.

In a three-count indictment Tackett was charged with second degree burglary, grand larceny, and receiving and concealing stolen property of the value of more than $100.00. A jury returned a not guilty verdict as to the first two counts but found him guilty on the third count, and his punishment was fixed at not less than three nor more than ten years in the state penitentiary.
