This is an appeal from a judgment of conviction entered against appellant Martin Ellis Brumit after a jury trial and verdict finding him guilty of a criminal offense.

On November 16, 1960, information charging armed robbery was filed against defendant Brumit and on the following day he pleaded guilty, was adjudged guilty, and was sentenced to 20 years imprisonment. On March 9, 1967, he filed motion under then Rule 1 to vacate the judgment, which...
