In this case there are no disputes as to the facts, which, for the most part, were freely admitted by the plaintiff in error who appeals from a conviction and five year Penitentiary sentence for burglary in the first degree in the Criminal Court of Sullivan County. Trial by jury was waived although there does not appear to have been compliance with the provisions of T.C....
