Plaintiff seeks by this proceeding to overturn the final determination of the Defendant that he is not entitled to child's insurance benefits under 42 U.S. C.A. § 402(d) and § 416(e). Both parties have moved for summary judgment. The facts as found by the Hearing Examiner are not in dispute.
