Defendant was indicted on October 15, 1931 for murder in the first degree. During the trial he entered a plea of guilty to murder in the second degree and was sentenced on March 21, 1932, to a term of 25 years to life. About 30 years later he obtained a vacatur of the judgment on the ground that the guilty plea had been induced by a promise of a sentence of 20 years to life.
