Plaintiff instituted this suit for total and permanent disability benefits, penalties and attorney's fees under the Louisiana Workmen's Compensation Act (LSA-R.S. 23:1021 et seq.). The injuries complained of resulted from a gunshot wound. Subsequently, more than a year after the date on which the injuries were incurred, plaintiff filed a supplemental and amended petition asserting an alternative claim in tort.
