DECISION AND ORDER

This cause comes before the Court on petitioner's second motion to vacate sentence and judgment of conviction under Section 2255 of Title 28 of the United States Code.

Section 2255 provides in pertinent part:

"A prisoner in custody * * * claiming the right to be released upon the ground that the sentence was imposed in violation of the Constitution * * * may move the court which imposed...
