OPINION

STONE, P.J.

Defendant appeals from his conviction by a jury of violation of section 20001 of the Vehicle Code. The appeal is on an agreed statement of facts which discloses that defendant's automobile was involved in an accident resulting in a fatality about 1:30 a.m. January 27, 1968. Defendant was a passenger in his vehicle, but he was not driving at the time of the accident.
