WATERMAN, Circuit Judge:

Appellant Valdes appeals from a judgment of conviction entered in the United States District Court for the Southern District of New York after a four day jury trial. The jury returned verdicts of guilty on three counts of a four count indictment. Appellant was found guilty on counts 1 and 2 in which he was charged with the unlawful selling of heroin on two different occasions in violation of 21 U.S.C. §§ 173, 174, and on count 4...
