On September 22, 1966, pursuant to summons Gambale appeared before the Suffolk County grand jury. When he refused to answer certain questions on the ground that his answers might tend to incriminate him contrary to the Fifth Amendment, he was brought before a judge of the Superior Court, who directed him to answer.
