The plaintiff in error (hereinafter referred to as the plaintiff) filed a claim in the estate of Esther B. Mills, her mother, who died testate on April 1, 1964. The claim was filed on November 10, 1966 and asserted a one-half interest in certain real property included in the estate of the deceased by her will.
