The defendant below, Edward L. Davis, was convicted of a crime against nature by engaging in fellatio with a fourteen-year-old boy and was sentenced to five years in the penitentiary.

Although the validity of the indictment has not been questioned, we have considered it to determine jurisdiction. The record shows that on the first day of the January term, 1967...
