The only two real areas of contention in this case involve (1) the water and sewer laterals beyond the lot line; and (2) the changes in grade to meet the city requirements. A third problem arises because we conclude that Diamond Homes incurs liability for the grade dispute: (3) What is the proper measure of damages ?
