BUSSEY, Judge.

Frank Naceo Martin was charged in the District Court of Oklahoma County with the crime of Murder. He was tried by a jury who found him guilty of Manslaughter in the First Degree, and assessed his punishment at nine and one-half years in the State Penitentiary, and he appeals.
